TERMS AND CONDITIONS

Welcome to tMuch-Ai Music Creator (“the App”). These Terms and Conditions (“Terms”) govern your access to and use of the App and its services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1. DEFINITIONS
“App” refers to tMuch-Ai Music Creator.
“User” refers to any individual or entity using the App.
“Generated Content” refers to music or audio created using the App’s artificial intelligence systems.
“Credits” refers to usage units required to generate music within the App.

2. USE OF THE APP
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App in any way that violates applicable laws or regulations.
- Attempt to reverse engineer, duplicate, modify, or exploit any part of the App.
- Use the App to generate content that is unlawful, harmful, offensive, or infringes on the rights of any third party.

3. AI-GENERATED MUSIC AND OWNERSHIP
The ownership and legal status of AI-generated music remains a developing and evolving area of law. Accordingly:
- tMuch-Ai Music Creator does not guarantee exclusive ownership or copyright protection over Generated Content.
- Users are granted a non-exclusive, non-transferable right to use Generated Content in accordance with these Terms.
- The legal treatment of AI-generated works may vary across jurisdictions and may change over time.

4. PERSONAL USE
Generated Content may be used for personal, non-commercial purposes without restriction, provided such use complies with these Terms and applicable laws.

5. COMMERCIAL USE
Generated Content may be used for commercial purposes; however:
- Such use is subject to change based on applicable third-party licenses, legal developments, or platform policies.
- Users are solely responsible for ensuring that their commercial use complies with all applicable laws and licensing requirements.
- tMuch-Ai Music Creator reserves the right to modify, restrict, or revoke commercial usage rights at any time without prior notice.

6. FREE AND CREDIT-BASED USAGE
The App may offer limited free music generation to Users. Beyond this free usage:
- Music generation may require Credits.
- Credits may be obtained through voucher codes or other purchasing mechanisms provided within or outside the App.
- Voucher codes, once redeemed, are linked to the specific device on which they are activated and may not be transferred, shared, or reassigned.
- Each music generation request consumes a certain number of Credits.
- Available Credits will decrease with each successful generation.
- Users must obtain additional Credits (“top-up”) once their balance is exhausted in order to continue generating music.
- All purchases of voucher codes or Credits are final and non-refundable, except where required by applicable law.
- tMuch-Ai Music Creator reserves the right to modify pricing, credit allocation, or usage requirements at any time.

7. THIRD-PARTY RIGHTS AND LICENSES
The App may incorporate or rely on third-party technologies, datasets, or licenses. Accordingly:
- Generated Content may be subject to third-party rights or restrictions.
- Users agree to comply with all applicable third-party licenses and intellectual property laws.

8. DISCLAIMER OF WARRANTIES
The App is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, tMuch-Ai Music Creator disclaims all warranties, express or implied, including but not limited to:
- Accuracy, reliability, originality, or fitness of Generated Content.
- Continuous, secure, or error-free operation of the App.

9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, tMuch-Ai Music Creator shall not be liable for any indirect, incidental, consequential, or special damages arising from or related to:
- Use or inability to use the App.
- Any claims, disputes, or legal issues related to Generated Content.

10. PROHIBITED CONTENT AND USER LIABILITY

Content Standards and User Responsibility

10.1 Prohibited Use. You may not use the App to generate, upload, or distribute any audio, lyrics, or content that:
a) Promotes, incites, or glorifies hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, nationality, or any other protected characteristic;
b) Degrades, defames, or disparages politicians, political parties, candidates for public office, or government officials;
c) Contains political campaigning, partisan political messaging, or content intended to influence elections, legislation, or public policy;
d) Is obscene, harassing, or otherwise promotes or endorses activities that are socially harmful, illegal, or contrary to public interest and decency.

10.2 User Liability. You are solely responsible for all content you create using the App. By using the App, you agree that you will not generate prohibited content as defined in Section 7.1. If you violate this clause, you acknowledge and agree that:
a) Your access to the App may be suspended or terminated immediately without notice;
b) You will be solely liable for any legal, regulatory, civil, or criminal consequences arising from your actions and from such content;
c) You agree to indemnify, defend, and hold harmless tMuch-Ai Music Creator, its affiliates, officers, and employees from any claims, damages, losses, or expenses resulting from your violation of this clause.

10.3 Enforcement. tMuch-Ai Music Creator reserves the right, but not the obligation, to monitor, review, and remove any content that violates these Terms, and to report illegal activity to appropriate authorities.

11. POLITICAL CONTENT RESTRICTIONS AND USER LIABILITY

11.1 Prohibition on Political Content. You may not use the App to generate, create, upload, or distribute any audio, lyrics, or other content that:
a) Degrades, defames, ridicules, or disparages any politician, political party, candidate for public office, government official, or state institution;
b) Contains political campaigning, endorsements, partisan political messaging, or content intended to influence elections, voting behavior, legislation, or public policy;
c) Mimics, impersonates, or falsely attributes statements to political figures or parties.

11.2 No Protection for Political Content. The App is not a platform for political expression. tMuch-AI Music Creator does not review, endorse, or assume responsibility for content you create. If you choose to generate songs or content targeting political figures or parties in violation of Section 11.1, you do so at your own risk.

11.3 Sole User Liability. You acknowledge and agree that:
a) You are solely and fully liable for any legal, civil, criminal, regulatory, or reputational consequences arising from content you create using the App, including but not limited to claims of defamation, hate speech, electoral law violations, or national security offenses;
b) tMuch- AI Music Creator will not defend, indemnify, or protect you from any legal action, investigation, or claim brought by any third party, political entity, or government authority as a result of your violation of this clause;
c) Your access to the App may be suspended or terminated immediately without notice if you breach this section, and tMuch- AI Music Creator may preserve and disclose your account information to law enforcement or authorities where required by law.

11.4 Cooperation with Authorities. tMuch- AI Music Creator reserves the right to report illegal activity and to comply with lawful requests for user data from courts, regulators, or law enforcement agencies.

12. MODIFICATIONS TO TERMS
We reserve the right to update or modify these Terms at any time. Continued use of the App after any changes constitutes your acceptance of the revised Terms.

13. TERMINATION
We reserve the right to suspend or terminate your access to the App at our sole discretion, without prior notice, if you violate these Terms or misuse the App.

12. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the Zimbabwean laws, without regard to conflict of law principles.

By using tMuch-Ai Music Creator, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
